1. Who we are

WhatFBO is operated by Avia Index Limited. "We", "us" and "WhatFBO" mean Avia Index Limited (trading as WhatFBO), a company registered in England & Wales, company number 16783750, registered office The Maltings, Rosemary Lane, Halstead, Essex, CO9 1HZ, United Kingdom. Contact: fly@whatfbo.com.

2. Definitions

A few key terms used in these Terms:

• Platform — the WhatFBO website (www.whatfbo.com), app and related services.
• User / you — anyone who accesses the Platform, including pilots, operators and FBOs.
• FBO — a Fixed Base Operator or ground-handling facility listed on the Platform.
• Content — anything posted on the Platform, including reviews, ratings, photos, replies and profile information.
• Membership — a paid plan (e.g. Sponsored) or paid add-on (e.g. Banner advertising).

3. Accounts and eligibility

You must give accurate information and keep your login secure. You must be at least 16 and able to form a binding contract. You are responsible for activity under your account. Tell us promptly at fly@whatfbo.com if you suspect unauthorised use.

4. The service and listings

Every FBO is listed; some features are free and some are paid. Listing tiers and ranking (Basic, Verified, Top Rated, and the paid Sponsored slot and Banner add-on) work as described in our onboarding materials. We may change features, ranking logic, pricing or availability, and we may correct or remove listings. We don't guarantee the Platform will always be available or error-free.

5. Reviews and user content

You own your Content, but you give us a licence to display it. By posting, you grant Avia Index Limited a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (for formatting) and publish your Content on and in connection with the Platform.

You confirm that your Content:

• is your own genuine, first-hand experience and honest opinion;
• is accurate and not misleading;
• does not infringe anyone's rights or any law; and
• complies with our Review & Acceptable Use Policy.

We can moderate. We may review, decline to publish, edit for format, or remove Content, and suspend accounts, in line with our Review & Acceptable Use Policy. We are not obliged to monitor Content but will act on valid reports.

6. FBO profiles, claims and right of reply

FBOs can claim and manage their profile, and reply to reviews. If you claim a profile you confirm you're authorised to act for that FBO and that the information you provide is accurate. FBOs have a right of reply to reviews about them but may not remove genuine reviews or post reviews about themselves or competitors.

7. Membership, fees and payment

Paid memberships and add-ons are billed as agreed at sign-up.

• Fees, billing frequency and any founding-rate discount are set out at purchase. Prices exclude VAT and other taxes unless stated. Currency is GBP unless agreed otherwise.
• Payments are handled by our payment processor, Stripe; we never see or store your card details.
• Unless stated otherwise, memberships renew automatically for successive terms of the same length. You can cancel at any time before the renewal date; cancelling stops the next renewal and your membership runs to the end of the term you have already paid for.
• Fees already paid are not refunded, including where a term is only partly used and where an account is suspended or terminated for breach of these Terms. This does not affect any rights you have under law that cannot be excluded.
• Only one FBO can hold the Sponsored slot per airport at a time.

8. Intellectual property

The Platform and our brand are ours. All rights in the WhatFBO name, logo, software, design and content (other than User Content) belong to Avia Index Limited or our licensors. You may not copy, scrape, resell or create derivative works without our written permission.

9. Disclaimers

Reviews are users' opinions, not our statements of fact. WhatFBO is a platform for user-generated reviews and FBO-supplied information. We do not endorse, and are not responsible for, the accuracy of reviews or FBO listings. Compliance/audit credentials are shown as supplied and should be independently verified. The Platform is provided "as is" and "as available" to the extent permitted by law.

10. Limitation of liability

Our liability is limited as far as the law allows. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or anything that cannot be excluded under law. Subject to that, we are not liable for indirect or consequential loss, loss of profit, goodwill or data, and our total liability to you in any 12-month period is limited to the greater of £100 or the fees you paid us in that period.

11. Indemnity

You cover us for misuse. You agree to indemnify Avia Index Limited against claims, losses and reasonable costs arising from your Content or your breach of these Terms or applicable law.

12. Suspension and termination

We can suspend or close accounts that break the rules. You can stop using the Platform or close your account at any time. We may suspend or terminate access where you breach these Terms or our policies, or where required by law. Provisions that by nature should survive (e.g. IP, liability, indemnity) continue after termination.

13. Changes

We may update these Terms. We'll post changes here with a new date and, for material changes, give reasonable notice. Continued use after changes means you accept them.

14. Governing law and jurisdiction

These Terms are governed by the law of England & Wales, and the courts of England & Wales have exclusive jurisdiction, save that consumers may benefit from mandatory protections of their home jurisdiction.
